Binding Legal Agreement

Terms & Conditions

By booking through RentCar.do, you agree to abide by the following operational, commercial, and legal regulations designed to ensure the safety and security of both parties.

1. Contractual Relationship

RentCar.do operates exclusively as a technological intermediary platform. It assumes no civil, criminal, or joint liability, nor acts as a guarantor for accidents, damages to third parties, death, or mechanical failures. All liability lies with the Vehicle Provider and the Renter, exempting the platform from any litigation.

2. Driver Requirements

  • Minimum Age: 21 years old. Drivers between 21 and 24 years old are subject to an additional "Young Driver" surcharge due to actuarial risks.
  • Valid License: Printed physical copy, valid for the entire rental period, and held for at least 1 year from its issuance date. Digital licenses without verifiable government backing are not accepted.
  • Identification: Valid Passport (for foreigners) or National ID Card (Cédula for Dominicans).
  • Strict Identity Match: The name printed on the Credit/Debit Card used for the online reservation MUST strictly match the name on the Driver's License and the Passport/ID presented physically upon pickup. Payments with third-party cards are not accepted under any circumstances.

3. Security Deposit & Payments

  • Credit Card Mandatory: It is mandatory to present a physical credit card (Visa, MasterCard, Amex) under the main driver's name. Debit cards, prepaid cards, or cash are not accepted for the security deposit.
  • Hold Amount: A hold (authorization) of $300 USD to $2,000 USD will be applied, depending on the vehicle category and insurance coverage selected.
  • Release: The funds are released upon returning the vehicle intact. The issuing bank may take 5 to 15 business days to reflect the availability of the funds.
  • Irrevocable Authorization: The client authorizes charges to their card for any excess damages, fines, loss of use, lost keys, or deductibles. The Renter formally and expressly waives the right to initiate bank Chargebacks for these concepts, accepting our telematics logs and digital signatures as conclusive evidence.

4. Geographic Restrictions & Misuse

Violation of any of these clauses will result in the immediate nullification of all insurance coverages, severe penalty fees, and, if necessary, remote immobilization of the vehicle via GPS.

Off-Road Use: It is strictly forbidden to drive the vehicle on beaches, dunes, rivers, unpaved local roads, unpaved mountains, or any terrain harmful to the chassis.
International Border: Prohibited to cross the border into the Republic of Haiti. Vehicles are equipped with geo-fences that will trigger engine shutdown.
Commercial Use/Subleasing: Prohibited to use the vehicle for transportation services (Uber, Didi, Taxis), towing, moving, or speed races.
Unauthorized Drivers: Only registered persons who have signed the physical contract are authorized to drive.
Privacy and Telemetry: The client consents to 24/7 GPS tracking and remote engine immobilization in case of breach or suspected fraud, exempting the platform from privacy claims or incidents arising from static immobilizations.
Illicit Acts & Confiscation: Prohibited to transport weapons, drugs, or undocumented persons. If the vehicle is confiscated or seized by the Public Ministry, the Renter must immediately pay RentCar.do the market value of the vehicle.

5. Fuel Policy

"Same-to-Same" policy. The vehicle must be returned with the same level of fuel as when delivered. Missing fuel will be billed at a premium rate that includes the price per gallon plus a refueling service surcharge (approx. $25 USD extra). The use of incorrect fuel (e.g., Diesel in a Gasoline vehicle) will be charged at 100% of the cost (Injector and tank cleaning, plus towing).

6. Traffic Fines & Tolls

The Renter is solely legally and financially responsible for traffic fines, parking tickets, and toll evasion. RentCar.do and the Provider reserve the right to charge the credit card on file the value of the infraction plus a $50 USD administrative fee for legal processing, even months after the rental has concluded.

7. Vehicle Condition

Cleaning: An "Extreme Cleaning" fee (starting at $100 USD) will be charged if the vehicle is returned with unusual dirt, deep stains, or excessive sand. Smoking is strictly prohibited; any trace of smoke or ash will result in a $250 USD penalty for professional deodorization. Lost Key (Smart Key): Loss, water damage, or locking of the vehicle key will generate an automatic charge between $300 USD and $500 USD, plus operational locksmith and towing costs. Pets: Transporting animals without a closed kennel resulting in excess hair or odors will incur the maximum cleaning fee. Hydrological Risk & Exclusions: Driving through flooded roads causing engine damage (Hydro-lock) is gross negligence not covered by insurance. The insurance also does not cover flat tires, rim damage from potholes, front suspension, or glass. Repairing the vehicle at unauthorized repair shops is strictly prohibited.

8. Cancellation, Modification & Late Return Policy

Early Cancellations: Reservations may be canceled without penalty provided the request is made at least 48 hours prior to the scheduled pickup date and time.

Late Cancellations & No-Show: If you cancel within 48 hours prior or fail to pick up the vehicle ("No-Show"), you will be charged a penalty equivalent to one (1) day's rental value of the reserved vehicle plus taxes. If prepaid, the remainder will be refunded.

Early Returns: We do not offer refunds or credits for unused days if the Renter decides to return the vehicle before the contract's end date.

Late Returns: We grant a grace period of 59 minutes after the agreed return time. After this time, an hourly rate (usually 20% of the daily rate) will be charged until reaching a 3-hour delay, at which point an additional full day of rental and insurance will be billed.

Misappropriation: Failure to return the vehicle 12 hours after the end of the contract, without formal communication, will be legally processed as the crime of 'Breach of Trust' (Article 408 of the Dominican Penal Code), proceeding to immobilization, police report, and seizure.

9. Insurance, Accidents & Police Reports

  • Police Report (DIGESETT): A formal police report is MANDATORY within 24 hours of any collision or scratch. Without the report, the insurance will decline the claim, and the client assumes 100% of the damage cost.
  • Deductible & Valet Parking: The client is responsible for paying the stipulated deductible. Handing the vehicle over to third parties not registered on the contract (including Valet Parking services) voids all insurance coverage.
  • Loss of Use: The Renter will pay the daily rental rate for each day the vehicle is immobilized in a repair shop or police retention center due to causes attributable to them.

10. Jurisdiction & Force Majeure

  • Governing Law: This contract is governed and interpreted under the laws of the Dominican Republic.
  • Jurisdiction: The Renter waives their home jurisdiction and agrees to submit any legal, civil, or commercial dispute exclusively before the courts of the National District, Santo Domingo.
  • Force Majeure: The company assumes no liability for service interruptions, damages, or inability to provide the service caused by atmospheric phenomena (hurricanes), strikes, or natural disasters.
